This public hearing is held in connection with AMLA's public consultation on draft Regulatory Technical Standards (RTS) on group-wide minimum requirements and additional measures for subsidiaries and branches in third countries, developed under the new Anti-Money Laundering Regulation (Regulation (EU) 2024/1624).
The draft RTS under Articles 16(4) and 17(3) of Regulation (EU) 2024/1624 clarify the requirements for the design and implementation of group-wide AML/CFT frameworks, including their application across cross-border group structures and in situations where branches or subsidiaries operate in third countries. In addition to addressing organisational aspects related to group-wide requirements, the draft RTS define provisions related to information sharing among entities of a group, provide criteria for identifying the parent undertaking in the EU where two or more obliged entities belong to a head office in a third country, and extend group-wide requirements to structures other than groups. The two mandates are inherently interlinked, reinforcing each other through cross-reference obligations and complementary requirements.
The public hearing offers stakeholders the opportunity to engage directly with AMLA on the proposed standards, with particular focus on ensuring that the requirements are effective and can be applied in practice across diverse group structures.
